Sales conditions

In our portal, all the prices are to be considered VAT included and transportation included. The prices constitute an offer to the public pursuant to art. 1336 of the Italian Civil Code.

Time and delivery mode

The time and method of delivery of the available products may vary depending on the buyer’s delivery address and product availability. Delivery times are approximately indicated at the time of check-out. Proximars will not be liable for damages directly or indirectly caused by the delayed execution of a contract or by the delay in the delivery of the goods, if the delay depends of eventual delays due to customs operations and border controls, or by major forces outside the control of Proximars. Upon delivery to the customer, ownership of the products is transferred from Proximars to the buyer

Obligations of the customers

The customers is obliged to communicate the correct, truthful and complete details in the phase of registration in merit to: personal and fiscal information (tax code and/or VAT number), personal contact details and other useful information useful for order fulfillment. The customer will pay the price of the products purchased and will keep a copy of the purchase confirmation at least until the goods are delivered.

Methods of payment.

The total price displayed at the end of the order includes shipping costs but it is not comprehensive of custom duties and/or additional taxes on the sales, necessary for the importation to a foreign country. Any additional charge will be borne solely and exclusively by the recipient. It is also possible for the EXTRA EU customers, the procedure of TAX REFOUND. The accepted payment methods are: bank transfer and credit card. The billing request must be done simultaneously with the order where requested during the check-out procedure. In the case of telephone orders, the customer must submit a written request, communicating the billing data. The documents will then be sent to the applicant in digital format via email.

Guarantee

The Legal Guarantee of conformity – to which Proximars guarantees as a seller – guarantees the goods against conformity defects with respect to the sales contract. In accordance with the law, in case of applicability of the Legal Guarantee, the buyer will have the right to restore the conformity of the goods without charge by replacement. Proximars is liable for lack of conformity if they occur within two years from the date of delivery of the goods.

The warranty is applicable when the products show damage and/or defects for which the buyer is not responsible after taking the correct precautions. The warranty excludes damage (by way of example but not limited to scratches, dents and stains) deriving from the mistreatment of the products. Right of withdrawal

The customer has the right to withdraw from the contract within 14 days from the delivery date of the goods are delivered to the address indicated in the purchase order, pursuant to Legislative Decree No. 50 of 15/01/1992 and subsequent amendments. Orders cannot be modified or canceled by the customer; in the event of an error, the customer undertakes to send written communication within 24 hours to the following addresses: info@proximars.com.

For the return to be valid, the customer is required to return the product – in any case within 30 days from the date of delivery of the goods – in the same condition in which he received it, to the address: Via Mutilati del Lavoro 4, Galliate (28066 ). Proximars reserves the right to check the integrity of the object.

Shipping and packaging costs are charged to the customer.

The customer can:

• Request the replacement of the product;
• Request a refund of the product price;
• Request a voucher of value corresponding to the amount paid, to be used later.

Applicable law

The contract will be governed and interpreted in accordance with the Italian law.

Privacy

Pursuant to Legislative Decree N ° 196/2003, we declare that by filling out the contact form (e-mail), or by sending their personal data, the customer authorizes Proximars to process their personal data. The aforementioned will be used only by Proximars, which may use them for sending information and propaganda material strictly related to the site.
